5. Cancellations, Rescheduling, and Refunds

Your purchase is subject to the Breath Alkemē Registration, Cancellation & Refund Policy, which is incorporated into these Terms by reference.

Unless otherwise expressly stated, all purchases are final.

Breath Alkemē reserves the right to cancel, postpone, or reschedule Services due to instructor illness, emergencies, insufficient enrollment, severe weather, technical issues, venue limitations, or other circumstances beyond our reasonable control.

 

6. Health & Medical Disclaimer

Breath Alkemē provides educational and wellness services intended to support general health and well-being.

Our Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition and should not be interpreted as medical advice, psychological counseling, or mental health treatment.

Participation in any Breath Alkemē Service is entirely voluntary.

You are solely responsible for determining whether participation is appropriate based on your physical and mental health.

Always consult your physician or another qualified healthcare provider before participating if you have any medical concerns.

Individuals with certain medical or mental health conditions—including but not limited to cardiovascular disease, uncontrolled hypertension, epilepsy, seizure disorders, detached retina, recent surgery, pregnancy (for certain practices), severe asthma, bipolar disorder, schizophrenia, psychosis, or other conditions that may be affected by breathing exercises—should consult an appropriate healthcare provider before participating.

 

7. Assumption of Risk

You acknowledge that participation in breathwork, movement, meditation, and wellness practices involves inherent physical and emotional risks.

These risks may include, but are not limited to:

• Dizziness

• Tingling sensations

• Emotional release

• Hyperventilation

• Temporary discomfort

• Changes in heart rate

• Muscle soreness

• Fatigue

• Loss of balance

• Fainting

You voluntarily assume all risks associated with participation and accept full responsibility for your own health, safety, decisions, and actions before, during, and after participation.

 

8. Coaching Relationship

Breath Alkemē instructors and coaches provide educational group breath coaching, breathwork instruction, and wellness education.

Unless expressly stated by a licensed healthcare professional acting within the scope of their professional license, no Service provided by Breath Alkemē constitutes psychotherapy, counseling, medical treatment, diagnosis, or mental health care.

No coach-client relationship shall be interpreted as creating a physician-patient, therapist-client, or other licensed healthcare relationship.

 

9. User Responsibilities

You agree to use the website and Services responsibly and respectfully.

You agree not to:

• Violate any applicable law or regulation;

• Disrupt or interfere with any Service or instructor;

• Harass, intimidate, or threaten other participants;

• Share account credentials where applicable;

• Copy or distribute copyrighted materials without permission;

• Misrepresent your identity or eligibility to participate;

• Use the Services for unlawful, fraudulent, or unauthorized purposes.

Breath Alkemē reserves the right to remove any participant or terminate access to the Services if these responsibilities are violated.

Unless otherwise expressly stated in writing, all Services, group breath coaching sessions, classes, workshops, courses, digital products, videos, audio recordings, educational materials, downloadable resources, and other content provided by Breath Alkemē are licensed solely for your personal, non-commercial use.

Your purchase or participation grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the purchased content solely for your own educational purposes.

This license does not transfer ownership of any intellectual property.

You may not:

Certain group breath coaching sessions, classes, workshops, courses, or events may be recorded for replay, educational, quality assurance, promotional, or future training purposes.

By participating in a recorded Service, you acknowledge that your voice, image, or likeness may appear in recordings.

If you prefer not to appear in recordings, you may choose to disable your camera, mute your microphone when appropriate, or notify the instructor before the session begins. While we will make reasonable efforts to accommodate such requests, we cannot guarantee complete exclusion from recordings in all circumstances.

 

15. Termination

Breath Alkemē reserves the right to suspend, restrict, or terminate your access to the website or Services at any time, with or without notice, if we determine that you have violated these Terms, engaged in unlawful conduct, acted in a manner inconsistent with the safety or well-being of other participants, or otherwise interfered with the operation of our Services.

Termination does not relieve you of any payment obligations incurred prior to termination and does not affect any provisions of these Terms that are intended to survive termination.
